Company Trip Policies -

Our efficiency in management and field operation minimizes costs
for the benefit of clients. This way we are able to make the
price very reasonable yet maintaining high quality service. Our
group tours/treks/expeditions and package trips are priced based
on double occupancy and a stated minimum number of clients yet,
are guaranteed to operate with a minimum of two people. Some of
the price components like; government fees for special permits,
taxes, airline tickets, transport costs etc. are subject to
change.
BOOKING
Specify a trip or package, intended travel dates and communicate
to Himaland or it’s representative in your any convenient mode –
email, fax, phone or in person. Your passport and contact
details are required for processing the bookings. A reservation
application is included with the brochure or we can send you one
by post or fax or email. Booking well in advance makes it easy
to better organize the trip. So, we encourage you to make
booking at least three months in advance.
A deposit of 30 % of the total bill amount is required to
confirm your booking. Total bill amount is due 3 months prior to
trip departure.
PAYMENT
The balance due has to be paid in full prior to departure of the
trip. The payment can be made by all major credit cards, bank
electronic remittance, travelers cheque and cash in any
convenient way for you.
CANCELLATION FEES & REFUND
Should you cancel your booking you must notify us in writing. On
receipt of this written notice, cancellation will be effected.
Cancellation Fees will be levied on the following percentage
basis of the total cost; 20 % any time prior to departure, 50 %
at least 30 days prior to departure, 75 % at least 15 days prior
to departure and 100 % for less than 15 days prior to departure.
In some cases, up to 20 % of the total cost may be refunded or
transferred as a deposit for next trips any time you notify the
cancellation.
PREPERATION
We will advise you step by step details for all trips so that
you are well prepared mentally and physically and be free of all
hassles. Upon confirmation of the booking, you will receive a
detailed trip itinerary, information on preparing for your
journey. Hotel contact list will be sent out approximately three
weeks prior to departure. If you have some specific queries and
enquiry regarding the trip, more information will be sent
promptly upon request.
FITNESS AND HEALTH
Depending upon the type of trip you undertake, physical fitness
level varies. Cultural and soft trekking trips are designed for
all age groups who are reasonably in a good health condition and
physically active. However, rigorous trekking, adventure sports
and mountaineering trips require a very good level of physical
fitness and consent by your doctor (physician).
INSURANCE
Your trip cost does not include travel or personal insurance.
For your protection, we highly recommend that you purchase
insurance policy covering your personal medical expenses,
emergency rescue by helicopter, baggage loss, trip cancellation
etc. at the time of booking.
Our local staff employed for your trips are insured under our
company’s insurance policy.
ITINERARY
The itinerary as programmed at the time of booking is followed
in general. On occasions, it may be necessary to adjust the
sequence of activities or hotels due to unforeseen circumstances
beyond our control such as weather, natural calamity, airline
schedule change, political disturbances, road detours etc. Any
extra costs incurred due to such changes should be borne by the
clients themselves. No refunds will be considered on the basis
of itinerary/route changes.
# Note:
* Himaland never had to drastically change an itinerary or trip
program in our last 10 years of operation.
On rare occasion
minor logistic changes are needed due to changes in conditions.
* We never have a dispute with our clients leading to the court
of law or any regulatory body or business
ethic council.
LIMITATION OF LIABILITY
Himaland Adventure Treks Pvt. Ltd., later referred to as Himaland, its owners, agents and affiliated companies act only
as agents for hotels, transportation companies, land operators
and suppliers of travel services and assume no liability in
connection with the operation or service of any transportation
vehicle or hotel which may be used for services to Himaland trip
members. Himaland and its operators and agents will assume no
liability for injury, damage, loss, accident, delay,
irregularity or additional costs resulting directly or
indirectly from any of the following causes: weather, natural
calamities, failure of any means of transportation to adhere to
schedules, quarantines, strikes, civil disturbances, theft,
government regulations, or changes in transport and lodging
beyond our reasonable control. Himaland reserves the right at
any time, either prior to or after departure, in its good-faith
discretion, change or reschedule any trip, including but not
limited to the right to alter or omit any part of the itinerary,
to substitute hotels or guides, or change any means of
conveyance without notice and without allowance of refund, with
the liability of increased costs – if any – to be borne by trip
members. Himaland reserves the right to change any itinerary at
any time when it is deemed appropriate for the safety of the
clients or to comply with government restrictions.
ASSUMPTION OF RISK AND RELEASE OF LIABILITY
Client acknowledges the risk and hazards of travel. By signing
the reservation form, client accepts responsibility for his/her
own welfare and waive future claims against Himaland Adventure
Treks Pvt. Ltd. referred to as Himaland hereinafter for
liability to the maximum extent permitted by law. Client
understands that Himaland contracts with a network of service
providers along the trip route. These third party service
providers are deemed qualified and experienced to the best of
Himaland’s knowledge. Client understands, however, that Himaland
is unable to fully supervise or guarantee the performance of
such third parties. Therefore client fully releases and holds
harmless Himaland from any and all liability for all their acts
or omissions. Client agrees that this Assumption of Risk and
Release of Liability statement shall be legally binding upon
client, all minors under the age of 21 traveling with the
client, client’s heirs, successors, and legal representatives.
Client further agrees to fully indemnify Himland from all and
any liabilities to the maximum extent permitted by law and for
all its costs, expenses, damages, etc. (including lawyer’s fees)
arising from or attributable to any claims or actions arising
from client’s travel with Himaland and which claims or actions
are specifically released by client.
